Terms of Service

1. Service description

DelayPay ("we", "us", "our") provides a transit refund recovery service. We submit compensation claims to transit operators on behalf of registered users ("you", "the user") for delays eligible under applicable passenger rights regulations.

2. Power of Attorney

By signing up and submitting a claim through DelayPay, you grant us a limited Power of Attorney to:

  • Act as your authorized representative with the relevant transit operator.
  • Submit refund claim forms using the ticket and trip details you provide.
  • Correspond with the transit operator regarding your claim on your behalf.

This authorization is limited solely to the purpose of recovering delayed transit refunds. You may revoke this authorization at any time by contacting us at support@delaypay.eu.

3. No-win, no-fee

Our service operates on a strict no-win, no-fee basis:

  • There is no upfront cost to submit a claim.
  • If your claim is unsuccessful, you owe nothing.
  • If a refund is successfully recovered, we charge a 25% commission on the recovered amount.

4. Fees & payment

Our fee of 25% is automatically deducted before payout. For example, if we recover €60 for you, you receive €45 and we retain €15. All fees are inclusive of applicable taxes.

5. Your responsibilities

You agree to:

  • Provide accurate and truthful trip details, ticket information, and bank details.
  • Not submit fraudulent or fabricated claims.
  • Not submit the same claim through another service or directly to the transit operator simultaneously.

Submitting false information may result in immediate termination of your account and may be reported to the relevant authorities.

6. Claim processing

  • We verify your delay against publicly available transit schedule data.
  • Not all delays are eligible for a refund. We will notify you if your claim does not qualify.
  • Processing times depend on the transit operator and are typically 14–30 days.
  • We are not liable for delays or rejections by the transit operator.

7. Limitation of liability

DelayPay provides a claim filing service. We do not guarantee the outcome of any claim. Our liability is limited to the fees you have paid us. We are not liable for any indirect, incidental, or consequential damages.

8. Account termination

You may close your account at any time by contacting us. We may terminate accounts that violate these terms or submit fraudulent claims. Outstanding claims at the time of termination will be processed to completion.

9. Governing law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.

10. Changes to terms

We may update these terms from time to time. Material changes will be communicated via email. Continued use of the service after changes constitutes acceptance of the updated terms.
